FOP Wins Victory in City of Killeen

Your affiliation with the FOP and the Texas FOP Labor Council is paying off.  TX FOP LC, Genreal Counsel Jason Nassour is hard at work protecting law enforcement across the state of Texas.

As many of you know departments across the state have been implementing physical fitness tests and some departments have associated those physical fitness tests with a punitive action.  That is what they tried in the city of Killeen.  On behalf of the local lodge, Jason Nassour, filed a law suit against the City of Killeen. On Wednesday, 02/10/2010, the 169th District Court ruled that though the city can legally implement a physical fitness program, their particular program did not comply with Chapter 143 of the Texas Local Government Code.  The Court denied the City of Killeen's Motion for Summary Judgment and granted the Plaintiff's Motion of Summary Judgment.

Jailers Seeking Collective Bargaining, What that means to Law Enforcement

NEW INFORMATION ON COLLECTIVE BARGAINING

The Travis County Sheriffs Officer's Association (TCSOA) bid to gain Collective Bargaining failed when not enough petition signatures were validated to get it on the ballot. TCSLEA favors Collective Bargaining but believes there is a more equitable solution availiable to both Associations than the one promoted by the TCSOA recently. TCSLEA will continue to fight for that solution and as always keep its members informed of our progress. 


Just so that everyone is up to speed, TCSLEA is in favor of collective bargaining. But, not under the current circumstance.  Under the current law if the Travis County Sheriff's Office had collective bargaining jailers would negotiate working conditions and policy that effect the way law enforcement protects the public.  Even though a large number of the jailers have a peace officer license they have never worked the streets and never answered a call.  They have excellent experience in protecting the security of a facility and the inmates housed there.  But, they have never been to a family disturbance, they have never investigated a crime, they have never investigated a collision or protected a collision or crime scene. 
 
For TCSOA, who represent Travis County jailers, to negotiate working conditions and policy for TCSLEA, who represent Travis County law enforcement, would be like Austin Fire Fighters negotiating working conditions and policy for Austin Police Department.  Or vice versa.  Both Firefighters and Police Officers are professionals with challenging jobs, however, either would be hard pressed to appropriately set policy and working conditions for the other. 
 
Over the weekend we planned to head out to the polls for the city elections.  With members and volunteers we manned 15 of the top 20 polling locations.  We took the oppotunity to hand out flyers and educate the voters.  We spoke with thousands of citizens and received good feedback on our issues.
